Echo is a product of Fifth Letter, Inc. (“Fifth Letter,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Echo website, application, and any related services (collectively, the “Service”).

By accessing or using Echo, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

Echo is an AI-assisted marketing and strategy support platform designed to help individuals and small teams clarify goals, explore ideas, develop plans, and navigate marketing decisions. Echo provides conversational guidance, prompts, and strategic direction to support thinking and execution.

Echo does not provide legal, financial, or professional consulting services. All guidance is informational in nature, and you are solely responsible for how you apply any insights or outputs provided by the Service.

Echo, including its design, features, software, branding, and content, is owned by Fifth Letter, Inc. and is protected by intellectual property laws.

You retain ownership of any content you submit to Echo. By using the Service, you grant Fifth Letter a non-exclusive, worldwide, royalty-free license to use, display, and process that content solely for the purpose of operating, maintaining, and improving the Service.

7. Use of Artificial Intelligence

Echo uses artificial intelligence systems to generate conversational responses, strategic guidance, and content suggestions.

You acknowledge and agree that:

• AI-generated outputs may be inaccurate, incomplete, or inappropriate in some cases

• Echo does not guarantee the quality, accuracy, or suitability of AI-generated content for any specific purpose

Your use of these services may be subject to the third parties’ own terms and policies. Fifth Letter is not responsible for the content, performance, or practices of third-party services.

9. Fees and Subscriptions

• All fees are non-refundable unless otherwise stated

• We reserve the right to change pricing with reasonable notice

You are responsible for any applicable taxes related to your subscription.

10. Termination

We may suspend or terminate your access to Echo at our discretion, including if you violate these Terms or use the Service in a manner that may harm Fifth Letter, other users, or third parties.

Upon termination, your right to use the Service will immediately cease. Certain provisions of these Terms, including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law, will survive termination.

11. Disclaimer of Warranties

ECHO IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

FIFTH LETTER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FIFTH LETTER DOES NOT WARRANT THAT ECHO WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIFTH LETTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE ECHO.

13. Indemnification

You agree to indemnify, defend, and hold harmless Fifth Letter, its affiliates, directors, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of Echo or your violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by updating the “Last Updated” date or through the Service.

Your continued use of Echo after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms or Echo shall be brought exclusively in the state or federal courts located in Forsyth County, North Carolina, and you consent to the jurisdiction of such courts.

17. Entire Agreement; Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
